Amicus Brief: Matter of Miller v. State of New York

The Marcy Syms Equality Initiative at the Birnbaum Women’s Leadership Center at New York University School of Law filed an amicus brief in Matter of Miller v. State of New York — the first case before the New York State of Court of Appeals on the ERA since the passage of New York’s Equal Rights Amendment in 2024. The Equality Initiative urges the Court of Appeals to hold that the Equal Rights Amendment to the New York State Constitution is self-executing and establishes an immediately enforceable cause of action for New Yorkers to seek redress for governmental discrimination on the basis of each enumerated protected classification.
